Terms of Service

1. Eligibility

• You must be old enough to use Discord in your region (13+ in most places; higher where local law requires).
• You must comply with Discord's Terms of Service and Community Guidelines.
• You must have authority to invite bots to any Discord server where you install kkachi. Operators are responsible for obtaining consent from voice-channel participants before enabling live transcription.

2. The Service

kkachi transcribes voice in Discord voice channels and posts translated text to a designated text channel. Transcription uses hosted speech-to-text providers and is subject to latency and accuracy limits described on the landing page. kkachi is not a real-time interpreter service and should not be relied upon for medical, legal, safety-critical, or emergency communications.

3. Acceptable Use

You agree not to misuse the service. Misuse includes (but is not limited to) the following.

• Using the bot to record or translate speech in channels where participants have not consented, in violation of applicable recording laws.
• Using transcripts for harassment, doxxing, or any unlawful purpose.
• Attempting to reverse-engineer the bot, bypass usage limits, or exploit provider quota.
• Uploading illegal content through the dashboard.

4. Plans and Billing

kkachi offers a Free plan and a paid Server Pro plan. Plan details, monthly usage quotas, and pricing are listed on kkachi.live/#pricing and may change with at least 14 days' notice. Billing for Server Pro is processed by a third-party payment processor; the payment processor's terms apply to the billing transaction.

• Fair-use quota. Server Pro plans include a monthly usage quota (currently 50 hours of voice audio per server). Exceeding the quota may result in transcription being paused until the next billing cycle or until additional usage is purchased.
• Cancellation. You may cancel Server Pro at any time from the dashboard. Pro features remain available until the end of the current billing period.
• Refunds. Fees for partial billing periods are not refundable, except where required by law.

5. Intellectual Property

• The kkachi brand, bot code, landing site, and dashboard are owned by the kkachi team. You may not copy, rebrand, or redistribute them without written permission.
• Transcripts generated in a Discord server are owned by the server or by the speakers, per Discord's content ownership terms. kkachi holds no ownership claim over generated transcripts.

6. Service Availability

kkachi is provided on a best-effort basis. Hosted speech-to-text providers occasionally experience degraded latency or outages; the service may be temporarily unavailable as a result. We do not guarantee uninterrupted operation.

7. Suspension and Termination

We may suspend or terminate the service for a server, user, or plan if we detect abuse of the service, violation of these Terms, non-payment, or risk to the platform. Server operators may remove the bot at any time from Discord, which immediately terminates service for that server.

8. Disclaimers

The service is provided "as is," without warranties of any kind, either express or implied. Transcription and translation output is machine-generated and may contain errors. We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the maximum extent permitted by law.

9. Limitation of Liability

To the maximum extent permitted by law, the kkachi team will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the service. Our total cumulative liability for direct damages is limited to the fees you have paid to the service in the twelve months preceding the claim, or USD $100, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless the kkachi team from any claims, damages, or expenses arising from your misuse of the service, your violation of these Terms, or your violation of any law or the rights of a third party.

11. Changes to These Terms

We may revise these Terms. Material changes will be announced in the kkachi support Discord server and noted in the "Last updated" date above. Continued use of the service after a material change constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles. Disputes will be submitted to the courts of the Republic of Korea, except where mandatory law provides otherwise for consumers.
